Initial Dispute Assessment

The lawyer identifies the proper parties, jurisdiction, venue, applicable law, remedy and limitation period. A weak evidence file cannot be repaired by elegant wording in a statement of claim.

In 2026, the Electronic Court subsystem is used to file claims, applications, responses, appeals and evidence, receive court documents and participate in hearings remotely. A company must monitor its electronic account and service deadlines: a missed electronic notice can have the same procedural consequences as an unread paper letter.

Court Proceedings and Interim Measures

The litigation strategy includes proving each element of the claim, responding to counterarguments, working with experts and witnesses, and maintaining the procedural timetable. Where there is a risk that assets may be disposed of, an asset freeze, prohibition on registration actions or other proportionate measures may be considered. Interim measures must not become pressure unrelated to the subject of the dispute.

Enforcement of the Judgment

After a judgment becomes final, the enforcement document is prepared and a state or private enforcement officer is selected where permitted by law. Information about the proceedings is recorded in the automated enforcement-proceedings system. Effective recovery requires tracing accounts and assets, monitoring seizures, valuing assets, challenging inaction and, where necessary, initiating insolvency proceedings.

Cross-Border Disputes

For a contract with a non-resident, the arbitration clause, place of proceedings, language, service of documents and the country where assets are located should be checked in advance. A Ukrainian court or arbitral award has value only where there is a realistic mechanism for its recognition and enforcement.
