Construction licence: how procedure practice and lists of works changed

In previous years, a construction licensing model was applied under Resolution of the Cabinet of Ministers of Ukraine No. 256 and the rules of the relevant period. The names of authorities, complexity categories, application forms and the permit system itself later changed.

What the licence covered

The licence and its annex recorded the list of permitted design, construction and installation works. The previous classification grouped them into general construction works, engineering infrastructure facilities and transport infrastructure.

Selecting an excessively narrow list restricted participation in contracts. An excessively broad list not supported by personnel, experience and the material and technical base created a risk of refusal or subsequent claims. The list therefore had to be formed according to the enterprise's actual specialisation.

The page from previous years contained recommended Word and PDF lists for repair and construction works, general construction of low-rise and high-rise buildings, monolithic-frame technology, internal and external engineering networks, design, installation, commissioning and general contracting.

What the enterprise confirmed

For document preparation, the manager, engineering and technical employees, education and experience of specialists, production premises, machinery, equipment, quality-control system and experience of completed works were analysed. Information in the statements had to be supported by personnel and technical documents.

In previous years, to obtain the relevant right, the enterprise submitted an application for issue of a licence, information about the enterprise, a description of attached documents, and applications for reissue, cancellation and changes to the list of works. The forms were tied to Resolution No. 256 and should not be used without checking the current procedure.

Purchase of a ready company with a licence

Ready enterprises with construction licences were also advertised separately. Before purchasing such a company, the buyer needs to check the validity of permit documents, work history, tax debts, court cases, employment relations, bank transactions, assets and legality of the change of control.

Result

Quality preparation is not about the maximum number of items in the annex, but about matching the declared works to the company's actual resources and contracts. In a modern project, it is necessary to determine separately the consequence class, permit document for the works, responsible executors, certificates and requirements for commissioning the facility.
