Customs law and the organisation of foreign-trade transactions

Effective customs work begins before shipment with the foreign-trade contract, tariff classification, origin, customs value, permits, and logistics route. An error at that stage often costs more than the declaration itself.

Tariff classification

The Ukrainian tariff code affects duty, excise, non-tariff measures, conformity documents, and statistics. Classification follows the product's characteristics, material, function, composition, and the interpretative rules, not merely the commercial description on the invoice. Complex equipment and sets may require a technical description, catalogues, drawings, and a documented preliminary classification position.

Origin and customs value

A preferential rate is available only where origin is properly evidenced and the relevant agreement's rules are met. Customs value is usually based on the transaction price, but freight, insurance, royalties, packing, and other elements may need to be added. Related-party transactions, discounts, free supplies, and third-party payments require separate explanation.

Contract and document set

• foreign-trade contract and specification;
• invoice, packing list, and transport documents;
• certificate or declaration of origin where preference is claimed;
• technical, sanitary, phytosanitary, or other permit documents;
• evidence of payment and customs-value components;
• sanctions, export-control, and counterparty screening.

Customs representative and authorisation

Under the current Customs Code, a customs representative may declare goods for another person subject to the required authorisation. The company should verify the representative's authority, contractual scope, responsibility for source data, and document-retention arrangements. Appointing a broker does not remove the importer or exporter's responsibility for accurate commercial information.

Simplifications and AEO

Businesses with stable trade flows may assess authorisations, comprehensive guarantees, simplified declarations, and authorised economic operator status. These require a compliance history, reliable accounting, financial standing, competent personnel, and supply-chain security. Simplifications work only where the company also maintains an internal customs-control framework.

After release

Customs release does not end compliance. The company should retain a shipment file, reconcile the declaration with accounting and tax records, monitor any end-use conditions, and prepare for post-clearance control. Errors may lead to additional duty, penalties, classification or valuation disputes, and delays to future shipments.
