EMPLOYMENT LAW AND HR DOCUMENTATION
Employment relationships are necessary for a business to operate its team properly: the director hires people, defines the work and remuneration, and the employee performs the duties and receives salary and the statutory protections. The main rules are established by the Labour Code of Ukraine, while during martial law Law No. 2136-IX applies with special provisions.
For the owner, HR documents should confirm who works for the company, on what terms, how much is payable and who has authority to access the company's money, data and property.
Employment Contract, Pay and Working Time
Before work begins, the director and employee agree the position, functions, place of work or remote arrangement, remuneration and other material terms. The employee is engaged in accordance with legal requirements, and the accountant receives the information needed to calculate salary and taxes. For the owner, this means personnel costs are known in advance, while the employee understands the role and authority.
Working time, leave, business trips, bonuses and additional payments are documented in accordance with the terms of employment and the current rules. During martial law, Law No. 2136-IX modifies some ordinary rules, so the director applies the version in force on the date of the HR decision. If an employee works remotely, the contract or order should specify equipment, communications, how tasks are assigned and the rules for working with corporate data.
Remuneration must comply with the agreement and statutory guarantees. The owner sets the team budget, while the director records salaries and the bonus system in the company's documents. Where part of remuneration depends on sales or other indicators, the employee should be told exactly what earns the bonus and when the entitlement arises. Clear terms reduce employment disputes and help forecast business costs.
Rights of the Director and Employee
The director is entitled to require performance of employment duties and compliance with established workplace rules. The employee is entitled to pay, rest, safe working conditions and other statutory protections. HR documents should distinguish employment duties, financial responsibility, access to commercial information and authority to sign documents on behalf of the company. Corporate and banking authority is granted separately, under the charter, owners' resolution, order, power of attorney or bank documentation.
For managers, accountants, sales staff and IT employees, confidentiality, rights to created materials and the return of property on termination are often important. These terms are recorded in employment and other documents within the limits of the law. If an employee uses online banking, a QES, CRM or cloud service, the director terminates that access at the same time as the HR decision so that the former employee no longer retains authority.
On termination, the director applies a specific legal ground, prepares the required documents and ensures the final settlement is made. Special rules apply to redundancy, changes to material terms of employment, disciplinary matters and certain situations during martial law. The owner should assess the wording of the order together with the actual circumstances: what happened, what evidence the company holds and which payments are due to the employee.
HR Documents for Stable Business Operations
Most companies need a clear set of documents: employment contracts or hiring orders, job duties, documents on remuneration, leave and working time, rules governing access to property and information, and documents terminating employment. The precise set depends on the number of employees, the nature of the work and whether there are remote employees, financially responsible persons or foreign nationals.
UBC can review HR documents before hiring, termination, a change in employment terms or a dispute. For advice concerning one employee, the employment documents and a brief description of the situation are sufficient. For the whole company, the owner can order an HR audit to identify documents that need to be aligned with the actual working arrangements and matters requiring a director's decision.
The cost depends on the number of employees, types of contracts, HR changes and the volume of legacy records. After the work, the director receives documents that can be used for hiring, remuneration and termination, while the owner sees the real personnel cost and the principal HR risks. The HR officer or accountant can continue routine personnel administration using the agreed documents.
It is useful for the owner to calculate the full cost of each employee separately: salary, taxes, leave, equipment, training and other recurring costs. This figure is needed when creating a new role and reviewing the price of goods or services. If part of the work can be outsourced more economically, the owner compares the contract price with the cost of an employee and chooses the option that best suits the business.

Can I order advice concerning one employee?
Yes. Hiring, changes to terms, termination, remote work or another issue concerning a specific person can be reviewed separately without auditing the entire company.
How should martial-law rules be taken into account?
On the decision date, the director applies the Labour Code together with the current special provisions of Law No. 2136-IX. Martial-law conditions are material to certain HR actions.

The HR officer receives agreed documents for day-to-day personnel administration, while the director receives conclusions on matters that require a management decision or changes to the employee's terms.
