Registration of Rights to a Land Plot and Obtaining Information from the Register

A page from previous years explained how an owner or other interested person could register a right to a land plot and obtain an information document from the state register. It distinguished between State Land Cadastre data about the plot itself and an entry in the register of proprietary rights concerning ownership, lease, servitude, superficies, emphyteusis or an encumbrance.

Cadastral data and the right itself are not the same thing

The cadastral number, area, designated use and boundaries describe the land plot as an object. Information on the owner or user and the legal basis for the right is confirmed by registration of the proprietary right. The existence of a cadastral number alone does not replace state registration of the right.

Where documents were submitted

The procedure previously used provided for filing through an administrative services centre or with a notary authorised to act as a state registrar. The choice affected the organisation of filing, timing and total cost, but did not change the requirements for title documents.

Main document package

• an extract from the State Land Cadastre if cadastral information was not obtained directly by the registrar;
• the applicant's passport and tax details;
• the document giving rise to the right: contract, inheritance certificate, court decision, act or other appropriate document;
• confirmation of payment of the administrative fee;
• power of attorney and the representative's documents if the application is filed by an authorised person;
• additional documents for a lease, servitude, superficies, emphyteusis or encumbrance.

Sequence of actions

First check the cadastral number and whether the area, address and designated use correspond to the title document. Next, determine the filing party, assemble the package and sign the application generated by the registrar. After review, the decision and information on the right become available in the register.

If the documents contain discrepancies in the area, owner's name, address, cadastral number or description of the legal basis, registration may be suspended or deferred until the discrepancies are resolved. Earlier state acts, inheritance, and the division or consolidation of plots often require separate preparatory work.

The previous service offered the document in electronic and paper form. Electronic information may contain an identifier for verification, but before submission to a bank, notary, court or foreign authority, the requirements for form, date of issue, translation and certification should be clarified.
